February 2023 has been a horror story across the country as more and more states are reporting their shockingly low bar exam scores.  Pass rates have dropped by a 5% average across the states. Some states have seen a double digit decrease.


The repeat taker pass rate was shockingly low  – the average repeat taker pass rate was less than 30%.  That means that 70% of the repeat takers failed the bar exam.


In addition, repeat bar exam takers have overtaken first time takers who sit for the bar exam.

One reason for these shocking low pass rates  is the MBE score, which dropped 1.5 points to 131.1 from last year. Repeat bar exam takers are seeing low MBE scores across the board.

The MBE mean scaled score have been low for the past few bar cycles, especially for repeat takers. The February bar exam draws a larger proportion of takers who have already failed the exam at least once and who are statistically more likely to fail again than first-time takers. Test takers who have previously taken but not passed a bar exam tend to show lower performance on the MBE than first-time test takers, and the majority of this February’s test takers nationwide were repeat takers. he New York bar exam results for July 2025 has been released. Repeat takers accounted for 30% of all candidates who sat for the bar exam. 36% of all candidates were foreign educated. The overall pass rate was 70%. The first time taker pass rate was 78%. The repeat-takers pass rate was 32%. The foreign educated candidates had a passing rate of 54%.
