Michigan’s Bar Exam Goes to the UBE for July 2022

The Michigan Supreme Court is moving to implement the Uniform Bar Examination (UBE) for Michigan bar exam applicants, effective for the July 2022 administration. 

Michigan will become the 40th jurisdiction to administer the Uniform Bar Examination. 
The UBE consists of three components: the Multistate Bar Exam (a day of 200 multiple-choice questions on seven subjects to test subject-matter knowledge), the Multistate Essay Exam (six 30-minute essay questions on any of twelve listed subjects, emphasizing written analysis), and the Multistate Performance Exam (two 90-minute writing assignments that test lawyering skills). The UBE is uniformly administered and graded. It results in a portable score that can be transferred to other UBE jurisdictions.

Michigan has administered the MBE but has not administered the MPT or MEE essays. Michigan essays have been 20 minute essays in contrast to he UBE 30 minute essays. Michigan currently lists 16 subjects, in contrast to the UBE’s 12 subjects.

Students at Michigan law schools who are open to practicing in other UBE jurisdictions will welcome the score-portability feature. Applicants can take the bar exam with the knowledge that they can transfer their score to almost anywhere a job offer might take them and a failing score can be transferred to jurisdictions with a lower passing score.

The Supreme Court has not announced what the passing score will be. The UBE has a maximum of 400 points. Other jurisdictions have set their passing scores between 260 (five jurisdictions) and 280 (one jurisdiction). The most common is 270 (fourteen jurisdictions). Neighboring Illinois’s is 266; Ohio’s is 270. Indiana is going with 264.

Also still to be revealed is whether a separate test or course on local law will be required. Currently, somewhat less than half of UBE jurisdictions have added a separate jurisdiction-specific test, course or combination of the two.

The MBE mean scaled score have been low for the past few bar cycles, especially for repeat takers. The February bar exam draws a larger proportion of takers who have already failed the exam at least once and who are statistically more likely to fail again than first-time takers. Test takers who have previously taken but not passed a bar exam tend to show lower performance on the MBE than first-time test takers, and the majority of this February’s test takers nationwide were repeat takers. he New York bar exam results for July 2025 has been released. Repeat takers accounted for 30% of all candidates who sat for the bar exam. 36% of all candidates were foreign educated. The overall pass rate was 70%. The first time taker pass rate was 78%. The repeat-takers pass rate was 32%. The foreign educated candidates had a passing rate of 54%.
